Store Rules
1. GENERAL INFORMATION
1.1. “Świat Krzeseł” is an online store available at www.swiat-krzesel.pl (hereinafter referred to as the “store”), and is owned by the company “MAGOD Łukasz Karolak”, 62-002 Suchy Las, ul. Brzask 4, NIP (tax ID no.) 6171517575, REGON (statistical no.) 302254149, conducting its business activity under an entry to the Business Activity Register issued by the Head of the Suchy Las Commune, which can be contacted by the customers under the following e-mail address: biuro@swiat-krzesel.pl.
1.2. A precondition for the purchase in “Świat Krzeseł” store shall be to accept the provisions of these regulations and to place an order.
1.3. The trademarks used on the website are registered by their respective owners and have been provided only for the identification purposes.
2. PRODUCT RANGE
2.1. All products available at “Świat Krzeseł” store shall be brand-new, free from physical and legal defects and have been legally placed on the Polish market.
2.2. The current product range shall be available at www.swiat-krzesel.pl.
2.3. Promotional sale shall include a limited number of goods. Orders shall be executed on a first-in, first-out basis until stocks are exhausted for this type of sale.
2.4. Promotional offers shall not be joined unless allowed by detailed conditions of a particular promotion.
2.5. Free advertising supplements (giveaways) shall not be subject to exchange or complaints.
2.6. All prices shall be indicated in Polish zlotys (PLN) and shall be gross prices inclusive of 23% VAT. The price indicated for every product shall be binding at the moment of placing an order by the Customer.
2.7. The store shall hereby reserve the right to change the prices of goods available in the offer, to introduce new and withdraw already existing goods as well as to carry out, cancel and modify rules of promotional campaigns.
2.8. For every order, “Świat Krzeseł” store shall issue a proof of purchase. At the Customer’s request, VAT invoices shall be issued (only for Customers from Poland). Customers from the European Union shall receive invoices with reverse tax in line with the commercial laws applicable in EU Member States.
2.9. Information included on the store website pages shall not constitute a binding offer in the meaning of the provisions of the Civil Code. When the Customer places an order using mechanisms available on the website of “Świat Krzeseł” store, they place a purchase offer of a particular product based on conditions included in the product description.
3. ORDER ACCEPTANCE AND DELIVERY
3.1. “Świat Krzeseł” store shall deliver its shipments via DHL courier company.
3.2. The Customer shall be obliged to pay the price for the product ordered from “Świat Krzeseł” store, including delivery price, no later than within 7 days from the date of concluding the agreement, provided the payment is made on delivery. The following types of payment shall be available:
– Cash on delivery – payment in cash when the product is collected from the courier,
– Wire transfer – a form of payment for Customers who prefer to log in to their online banking service or pay a visit to a bank branch. After placing an order, the Customer shall receive (by e-mail) the number of the bank account to which the payment must be transferred. When the payment is credited to the bank account of Świat Krzeseł store, the order shall be handed over for delivery,
- PayU online transfer – a form of electronic payment processed by PayU S.A. – a national payment institution with its seat in Poznań, ul. Grunwaldzka 182, entered in the National Court Register kept by the District Court for Poznań – Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register under KRS no. 0000274399.
3.3. Orders shall be accepted by the “Świat Krzeseł” store staff:
- using Świat Krzeseł store software available at swiat-krzesel.pl,
- by e-mail at: biuro@swiat-krzesel.pl.
3.4. Sales shall only be conducted based on correctly performed ordering process and in case of orders placed via e-mail – only after disclosing all information required in the ordering process.
3.5. “Świat Krzeseł” store shall reserve the right to refuse to deliver an order placed by the Customer when the authenticity of the order raises reasonable doubt.
3.6. “Świat Krzeseł” shall reserve the right to confirm the order by phone or e-mail. Such order may then be cancelled if it is not possible to contact the Customer within 72 hours from the moment of placing the order.
3.7. Acceptance of orders for execution shall commence (on working days):
a) for “cash on delivery” orders – immediately after the order has been placed,
b) for wire transfer orders – after the payment for ordered goods has been credited to the account,
c) for orders paid by debit and credit cards – in the case of online payments – at the moment of transaction authorisation.
3.8. The Customer may change or withdraw from the complete order until it has been sent.
In order to do so, the Customer must contact the service of “Świat Krzeseł” store via e-mail (address: biuro@swiat-krzesel.pl).
3.9. The order shall be executed provided that the goods are available in stock or at the suppliers. If some of the goods ordered are unavailable, the Customer shall be informed on the status of the order and shall make a decision regarding its delivery (partial delivery, prolongation of waiting time, cancellation of the entire order).
4. DELIVERY AND SHIPMENT COSTS
4.1. Orders placed until 9.00 a.m. shall be shipped on the same working day. Orders placed after 9.00 a.m. shall be shipped on the next working day. This means that orders placed by 9.00 a.m. on Monday shall be shipped on Monday. Orders placed after 9.00 a.m. on Monday may be shipped on Tuesday. Orders placed after 9.00 a.m. on Friday may be shipped next Monday.
4.2. Shipments sent via courier company are delivered within up to 2 working days.
4.3. If the payment is not sent within up to 7 days since placing the order, the order shall be cancelled. This shall be equal to the termination of sales agreement. The buyer shall receive an e-mail with information about the situation and the reason for order cancellation.
4.4. The agreement concluded between the Customer and the store regarding purchase of a given product at Świat Krzeseł store shall be limited in time and shall last only during the order delivery time. The place for providing a service related to the purchase of products at “Świat Krzeseł” store shall be the delivery address indicated by the Customer, excluding products collected personally.
5. WITHDRAWAL FROM THE AGREEMENT
5.1. Pursuant to the Consumer Rights Act of 30 May 2014, the Customer may resign from the goods purchased at the store without giving a reason within 14 days from the date of collecting the shipment.
5.2. In the event of withdrawal from the agreement, the Customer shall be obliged to inform Świat Krzeseł store about the intended withdrawal within 14 days from receiving the goods. Then, within 14 days from delivering information about the withdrawal, the Customer shall return the goods to: Świat Krzeseł, 60-650 Poznań, ul. Obornicka 229B/9, together with an appropriate written declaration. Returning the goods with the written declaration within 14 days from its receiving shall be tantamount to the fulfilment of the obligation to inform about the intention to withdraw from the agreement.
5.3. “Świat Krzeseł” store guarantees to reimburse the amount equal to the price of the goods and if all products from the order were returned, also the cost of the delivery. The money shall be returned immediately and no later than within 14 days from the moment of receiving the goods (after informing the store in writing about the intended withdrawal from the agreement).
5.4. “Świat Krzeseł” store shall reimburse the payment in the same way as the goods were paid for in the initial transaction. The Customer shall have the right to decide to get a reimbursement by a bank transfer by including their bank account number in the declaration of withdrawal from the agreement or by providing the number in any other way to “Świat Krzeseł” store. In any case, the Customer shall not pay any fees related to the reimbursement.
5.5. The Customer shall be responsible for the decreased value of the goods resulting from their use beyond what is necessary to establish the nature, the features and functioning of the goods.
5.6. “Świat Krzeseł” store shall not accept cash on delivery shipments.
6. COMPLAINTS AND WARRANTIES
6.1. The “Świat Krzeseł” store staff make every effort so that the goods sent are free of defects and meet the customers’ expectations. The ordered products shall be carefully checked prior to sending.
6.2. The products have a warranty from the manufacturer, importer or seller which is applicable in Poland. The warranty period for each product is included in its description on “Świat Krzeseł” online store website. In the event of a complaint, the Customer should immediately contact the “Świat Krzeseł” store staff via e-mail (at: biuro@swiat-krzesel.pl).
6.3. All complaints shall be processed within 14 working days form the date of their receipt.
6.4. “Świat Krzeseł” “MAGOD Łukasz Karolak” store shall be liable for product defects in accordance with the applicable laws. In the case of sales other than consumer sales, implied warranty regulations contained in the Civil Code shall not apply.
6.5. The claimed goods shall be returned together with a description of the defect to: Świat Krzeseł, 60-650 Poznań, ul. Obornicka 229B/9. The claimed goods shall have their defect removed or be exchanged to goods free from defects.
6.6. Instead of defect removal offered by the seller, the Customer may demand an exchange for a product free from defects or instead of an exchange, demand removal of the defect unless making the product compliant with agreement in the manner chosen by the buyer is impossible or requires excessive costs compared to the method offered by Świat Krzeseł store.
6.7. The Customer shall have the right to withdraw from the agreement if the request for repair or exchange may not be fulfilled by “Świat Krzeseł” store or requires excessive cost from “Świat Krzeseł”. “Świat Krzeseł” store may offer other goods from its product range in consultation with the Customer, however the Customer shall not be obliged to consent.
6.8. In each of the above cases, if the fulfilment of Customer’s request requires delivery of a new or repaired product and requires from the Customer to return the goods to “Świat Krzeseł”, the cost of delivery shall be covered by “Świat Krzeseł” store.
7. CUSTOMER’S PERSONAL DATA
7.1. Personal data provided by Customers shall be collected and processed by Świat Krzeseł “MAGOD Łukasz Karolak” store in accordance with the applicable laws and the Privacy Policy.
7.2. The Customers may use “Świat Krzeseł” store by registering and thus creating an account where data and information about the Customer’s activity in “Świat Krzeseł” store (hereinafter referred to as the “Account”) is collected. Provision of services as part of the Account in “Świat Krzeseł” store shall not be limited in time. The Customer shall have the right to withdraw from an agreement with “Świat Krzeseł”, “MAGOD Łukasz Karolak” store, 62-002 Suchy Las, ul. Brzask 4, regarding the Account at any time by filling out a form which includes a declaration of withdrawal from the agreement. The above shall not refer to a situation in which “Świat Krzeseł” store is delivering an order placed by the Customer. In such a case, the agreement shall be terminated when the order in question is fully delivered.
7.3. Creation of an account in “Świat Krzeseł” store shall not be obligatory. It shall be possible to place an order by providing a one-time consent for processing personal data in order to deliver the order in question.
7.4. In order to register an Account at “Świat Krzeseł” store, a registration form must be filled with the following details: name and surname, place of residence, phone number, e-mail address and password. A message shall be sent to the Customer’s e-mail address provided in the registration form to indicate the way to confirm registration and other legally required information. Upon confirmation of registration, an agreement shall be concluded for keeping an Account between the Customer and Świat Krzeseł “MAGOD Łukasz Karolak” the subject of which shall be services provided by “Świat Krzeseł” “MAGOD Łukasz Karolak” upon the terms and conditions stipulated in these Regulations.
7.5. The Customer may agree to have their personal details disclosed in the registration form for “Świat Krzeseł” store to be processed for marketing purposes and to agree to receive commercial information from Świat Krzeseł store owners via electronic means of communication and regular mail. The Customer shall have the right to access and correct their personal data.
7.6. The Customer shall have the right to access and correct their personal data. The data shall be provided voluntarily. User data shall be subject to protection according to the Privacy Policy of “Świat Krzeseł” store.
8. OTHER INFORMATION
7.1. All matters not provided for herein shall be governed by the provisions of the Civil Code and the Consumer Rights Act of 30 May 2014.
7.2. “Świat Krzeseł” “MAGOD Łukasz Karolak” store may amend these Regulations and implement a new version of services provided within “Świat Krzeseł” store. The amendments shall become effective at the time indicated by “Świat Krzeseł” store owner, which may not be shorter than 7 days from the moment the amended Regulations are made available at “Świat Krzeseł” store, provided that orders placed prior to the entry of the amendments into force shall be delivered based on previous terms and conditions.
